State v. G.V.M. - Prosecutor Completely Dismissed Gross Misdemeanor DWI
We recently shared our victory in G.V.M. v. Comm'r of Pub. Safety, where the court threw out our client's 1 year license revocation for trest refusal and fully reinstated our client's license to drive. We noted that we were off to fight criminal case.
Here’s the update:
We forwarded the Court’s Order from the driver’s license case to the state along with information about our client. GVM had taken steps to address any potential underlying chemical dependency issues which were well documented. We requested the state to dismiss the criminal charges in light of the ruling. The Order didn’t bind the state, and the prosecutor was free to relitigate the issue.
Fortunately, the state agreed and served us this week with a notice dismissing all charges!
