Jirik v. Commissioner of Public Safety
Our client had his driver's license revoked after his arrest for DWI. We were hired to appeal his loss of license, and convinced the Minnesota Court of Appeals to give it back.
The Court ruled that the state violated our client's Due Process rights when they threatened him with the crime of test refusal before demanding that he submit to a urine test. The Court concluded that Minnesota's Implied Consent Advisory was fundamentally misleading and therefore unconstitutional.
