State v. D.A.B.

Our client was charged with his second DWI within 10 years – a Gross Misdemeanor – with a breath test reported as over 0.08. We exposed the scientific limitations of the breath test using measurement uncertainty. After we won the civil driver’s license case last fall, we convinced the prosecutor to dismiss all the DWI charges and allow our client to plead to a careless with no jail.
