State v. K.D.Y.

07/06/22

K.D.Y. came to us after being pulled over for driving on a cancelled license. Our client admitted that he had consumed meth earlier in the day, and law enforcement obtained a search warrant for his blood. Lab analysis of the blood sample revealed the presence of methamphetamines, and because our client also had prior DWI convictions, he was charged with Gross Misdemeanor DWI.

We watched all of the body worn camera videos and came to one conclusion: K.D.Y. never should have been arrested in the first place. Using our experience attacking field sobriety tests, we convinced the judge to throw the entire criminal case out. We then convinced the Attorney General’s office to avoid a losing battle with us, and they agreed to administratively throw out the license revocation too!
